We also understand the frustration of many video creators over the current state of fair use understanding. As we noted in the book, the Code of Best Practices in Fair Use for Online Video, created on the basis of what then was current practice online and with the assistance of impressive legal advice from the blue-ribbon committee that shaped the Code, provides help in knowing what is the safe center of fair use practice. There are solid fair use arguments for uses that go beyond the code (as the code notices). As the book notes, the arguments of the Organization for Transformative Works for a fair use argument for entire songs being used in a video are worth engaging; while current usage may still be in fair use's "grey" area rather than in a safe harbor, changing practice may move it much closer to the center. We strongly believe that it is important to challenge the DMCA's penalizing of those who want to employ fair use. In fact, this fall, it seems that the Copyright Tribunal will once again entertain arguments for exemptions to the criminal penalties for breaking encryption to access material for fair use purposes. Please alert colleagues who might be interested in making such a petition. Documentary filmmakers, professors, librarians and vidders have successfully won major exemptions to date.]]></description>
